1. Acceptance & Scope

By using https://niftyfixesne.co.uk (the “Site”) or engaging Nifty Fixes NE Ltd for services, you agree to these Terms and our integrated Privacy Policy. We provide residential and commercial property maintenance, electrical services (EICR/PAT), CCTV installation, and facilities management.

2. Privacy & Digital Infrastructure

Your data is handled according to our ROPA and DPIA: * Nextcloud Environment: All project files, photos, and certificates are stored in a secure, encrypted Nextcloud instance (UK Hosted). * Backups: Hourly encrypted backups are maintained in the EU under the UK-EU Adequacy Decision. * Security: We enforce Multi-Factor Authentication (MFA) and a “No External Storage” policy for all staff handling your data.

3. Service Provisions & Guarantees

  • Workmanship: All installations are backed by a 12-month workmanship guarantee.
  • Warranty Exclusions: The guarantee is voided by third-party interference, misuse, or accidental damage. A £60 call-out fee applies for non-warranty visits.
  • Photography: We document site progress for safety and quality control. Marketing use of images is subject to your consent during the quote acceptance process.

4. Financial Terms

  • Invoices: All invoices are Due on Receipt unless otherwise stated.
  • B2B Interest: We exercise our statutory right to interest under the Late Payment of Commercial Debts Act 1998 for business clients.
  • Recovery: Legal title to all goods remains with Nifty Fixes NE Ltd until full payment is cleared. We reserve a right of entry to recover unpaid materials (Ref: Invoice Terms Section 2.3).

5. Statutory Dispute Resolution (2025 Act)

In accordance with the Data (Use and Access) Act 2025, you must follow our internal resolution process before escalating to any regulator: 1. Notice: Contact hello@niftyfixesne.co.uk with your concern. 2. 30-Day Resolution: We have a statutory 30 days to investigate and resolve the issue. 3. Escalation: Regulatory or legal action may only be initiated after this period has concluded.

6. Limitation of Liability

Our liability is limited to the value of the specific service provided. We are not liable for any indirect or consequential loss, nor for issues arising from third-party hardware or software modifications.
