1. Payment Terms & Deposits

1.1 Due Date

All invoices are Due on Receipt unless a specific alternative date is agreed upon in writing and stated clearly on the face of the invoice.

1.2 Deposits (Section 1.2)

  • A deposit is required for any project exceeding £500 or where bespoke/specialist materials must be ordered in advance.
  • Materials deposits are non-refundable once the order has been placed with our suppliers, as these are “bespoke to order.”
  • Work will not commence, and dates will not be confirmed in the schedule until the deposit has cleared in our accounts.

1.3 Payment Methods

Payments must be made via Bank Transfer (BACS). Please use your Invoice Number as the payment reference to ensure your payment is allocated correctly. Payment instructions and bank account details are provided on the face of every invoice issued.

1.4 Variations & Additional Work (Section 1.4)

Any changes or additions to the scope of work originally quoted must be agreed upon in writing (email or messaging is acceptable). Nifty Fixes NE Ltd reserves the right to issue a revised estimate or a supplementary invoice for such variations.

1.5 Cancellations (Section 1.5)

  • Business Clients (B2B): Cancellations within 48 hours of the scheduled start time will incur a fee equal to 25% of the labour quote plus any non-returnable material costs.
  • Domestic Clients (B2C): In accordance with the Consumer Contracts Regulations, you have a 14-day cooling-off period. However, by requesting an immediate start or emergency repair, you explicitly agree to waive this right to the extent that the service is performed before the end of the cooling-off period.

1.6 Late Payments (B2B vs B2C)

  • B2B: We reserve the right to charge interest and debt recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998 at a rate of 8% above the Bank of England base rate, plus statutory fixed costs.
  • B2C: Late payments may result in the suspension of all ongoing works. We reserve the right to withdraw the 12-month workmanship guarantee until the balance is cleared in full.

1.7 Site Access & Preparation (Section 1.7)

The client must ensure engineers have clear, safe access at the agreed time. If a site visit is aborted due to lack of access or unsafe conditions (not caused by us), an ‘Abortive Visit Fee’ of £60 + VAT (where applicable) will apply.

2. Retention of Title & Recovery

2.1 Ownership

Legal title to all goods and materials supplied by Nifty Fixes NE Ltd (the “Goods”) remains with the Company and shall not pass to the client until the invoice is paid in full.

2.2 Right of Recovery (Section 2.3)

In the event of non-payment by the due date, Nifty Fixes NE Ltd reserves an irrevocable licence to enter the client’s premises (or any premises where the goods are stored) to recover and remove any materials or equipment supplied that have not been paid for.

3. Warranty & Workmanship Guarantee

3.1 12-Month Guarantee

We provide a 12-month workmanship warranty from the date of completion. This covers manufacturing defects in supplied goods and issues directly related to our installation.

3.2 Exclusions & Service Charges

The warranty is voided by third-party interference, misuse, or accidental damage. If we attend a warranty claim and the fault is found to be excluded (e.g., user error or third-party work), a non-warranty service charge of £60 will be applied.

4. Data Protection & Compliance

4.1 Storage & Privacy

Your invoices and certifications are stored in our secure, encrypted Nextcloud environment (UK Hosted). We retain financial records for 6 years to comply with HMRC requirements.

4.2 Dispute Resolution (Data (Use and Access) Act 2025)

A mandatory 30-day internal resolution period applies to all disputes. You must notify us at hello@niftyfixesne.co.uk and allow 30 days for a formal response before escalating to any external regulator or legal body.
